Background: Our client, the executor of an estate, sought the information on the whereabouts of funds and proceeds on six estate owned properties. In the interim our office obtained a restraining order restraining the operation of the properties, which included several Manhattan hotels, a Manhattan apartment building, an upstate building complex, and a commercial mortgage lender. The opposing party, with an interest in the properties appealed the order of the Surrogate’s Court.

Decision: The Appellate Division, Second Department, affirmed the order of the Surrogate’s court in our favor with costs payable by the appellants personally.
